Créée en novembre 2023 par le régime militaire, la Cour d’Etat du Niger a annulé l’immunité de l’ancien président Mohamed Bazoum le vendredi 14 juin. Cette décision pourrait donner lieu à un éventuel procès pour Bazoum qui a été déposé lors d’un coup d’État le 26 juillet 2023. Depuis la prise de pouvoir militaire, Bazoum et son épouse, Hadiza, sont détenus dans des conditions austères à la résidence présidentielle.

Vive l’ère de l’arbitraire. » Il a déploré la situation, déclarant : « Nous sommes dans une situation absurde. La Cour vient de prendre une décision très lourde de conséquences tout en violant les droits fondamentaux de la défense : nous n’avons pas été autorisés à rencontrer notre client et la Cour a refusé d’entendre nos arguments »
Les accusations portées contre l’ex-président renversé
Les autorités de Niamey accusent Bazoum d’ « atteinte à la sécurité et à l’autorité de l’Etat », « trahison », « incitation présumée au terrorisme » et « financement du terrorisme ». On lui reproche notamment d’avoir sollicité l’appui du président français, Emmanuel Macron, et du secrétaire d’Etat américain, Antony Blinken, pour une « intervention armée » lors du coup d’Etat de 2023.
Les divers obstacles au procès
L’audience du vendredi a été reportée à deux reprises suite aux objections des avocats de Bazoum qui ont dénoncé plusieurs entraves au droit de la défense. En décembre, la Cour de justice de la Communauté économique des Etats de l’Afrique de l’Ouest avait demandé sa libération. Cette requête est restée sans réponse et le Niger a quitté l’organisation ouest-africaine en janvier, qui avait sanctionné le Niger après le coup d’Etat avant de lever ses sanctions le 24 février.
